For Koch Brothers, All Politics Is Local

The Tennessee State Senate brokered a deal this week to move forward with a hotly contested bus rapid transit (BRT) project. The bill will provide the city of Nashville and neighboring Moore County with 7.1 miles of rapid bus transit lanes. But because of the compromise in the Senate, the BRT plan will now face greater oversight: The proposed buses will be allowed to use lanes separate from regular traffic, but will need approval from the state Assembly and by the commissioner of transportation before constructing those lanes.

Prior to Thursday, the Tennessee State Senate had been blocking the bill, in part because of an effort by a group affiliated with noted Republican donors Charles and David Koch.

The Koch brothers, and the Tennessee arm of their political organization Americans For Prosperity, had no explicit economic interest in blocking the bus project from moving forward. Rather, as the Tennessee director of Americans For Prosperity told The Tennessean in March, it was something of a trial run for implementing Koch-backed legislation around the country. “With supermajorities in both houses,” AFP state director Andrew Ogles told the paper, “Tennessee is a great state to pass model legislation that can be leveraged in other states.”

The citizens of Nashville and Moore County, however, are not the first Americans to feel the effects of the Kochs’ “model” legislation.

In a similar example of Koch influence on the local level, in 2012 Americans for Prosperity joined the effort to halt a streetcar project in Milwaukee, Wisconsin. The streetcar plan would connect the lower east side of the city with an Amtrak station two miles away.

The drive was led by Republican alderman Bob Donovan. After construction was approved by the Milwaukee Common Council, Donovan held numerous press conferences in the attempt to publicize a petition and force a referendum on the streetcar plan.

The effort got a leg up when Americans for Prosperity set up a website, “A Streetcar Named Disaster,” to gather signatures for Donovan’s petition.

Donovan’s union with Americans for Prosperity led other elected officials to question his loyalties. Jeff Fleming, then-spokesman for the Department of City Development, said in a statement: “We never hear Ald. Donovan complain about his Republican friends cutting Milwaukee’s local road aids, our recycling aids or our state shared revenue, which funds police and firefighters. The alderman is so tight with groups and individuals who love gutting and kicking Milwaukee, you have to wonder where his loyalties are.”

Coincidentally, the streetcar project is a hallmark of Mayor Tom Barrett’s administration. Barrett unsuccessfully ran for governor of Wisconsin in 2010 and again in a recall election in 2012, losing to Republican Scott Walker both times. Walker has a close relationship with Americans for Prosperity, who argue that his anti-union legislation is an example that other Republican governors should follow.

Like the proposed rapid transit plan in Nashville, the Milwaukee streetcar plan has moved ahead over AFP’s objections.

The Kochs’ distaste for government-subsidized transportation did result in one big victory on the state level. In Florida, a large mass-transit plan to bring high-speed rail to the state was rejected after Republican Rick Scott was elected. The plan would have used state and federal funds to connect the cities of Tampa and Orlando, with plans to extend it to other tourist hotspots in southern Florida.

The Koch brothers’ fingerprints were all over Scott’s rejection of the plan. For starters, Governor Scott and the Kochs have a long and storied relationship. Scott, for example, famously attended a secret, invitation only meeting held by the Koch brothers in Colorado soon after being elected Florida governor.

The Koch brothers’ influence over Florida’s high-speed rail plan, however, extends beyond their relationship with Governor Scott.

As Curt Levine, former legislator in the Florida House of Representatives, noted at the time, Scott’s decision to nominate Robert Poole as transportation advisor deftly revealed the Koch brothers’ influence in his administration.

Levine wrote in a 2011 op-ed: “Poole is director of transportation policy at the Reason Foundation, a right-wing lobby group of road-based transportation industrial interests, including petroleum, asphalt and rubber-tire manufacturers. And, not coincidentally, Reason receives substantial funding by the ultraconservative billionaire Koch brothers. David Koch serves as a Reason trustee.”

Levin further explained that Scott’s decision to reject the high-speed rail plan was based, in part, on a report by the Reason Foundation that urged Scott to reject the plan “as Wisconsin and Ohio have recently done.”

The fact that Koch-funded groups are influencing even the most local policy decisions should perhaps come as no surprise. As The Nation reported in 2011, the Koch brothers have been funding the American Legislative Exchange Council (ALEC) for years. The council touts itself as an organization that brings together conservative state legislators and members of the private sector to further free-market principles. And ALEC has been living up to that tagline — in precisely the way the Koch brothers want it to.

    Sen. Joe Manchin on Thursday strongly defended the Koch brothers from attacks by fellow Democrats, saying the wealthy and politically active businessmen are taxpaying Americans who are creating jobs.

    “People want jobs. You don’t beat up people. I mean, I don’t agree with their politics or philosophically, but, you know, they’re Americans, they’re doing— paying their taxes,” Manchin said on Fox News’s “Fox & Friends.”

    When asked whether Senate Majority Leader Harry Reid’s attacks on the Koch brothers “helps or hurts the cause for the country and the Congress,” the West Virginia senator said it’s people in the middle that need to be reached.

    “If you’re trying to rally the base, the bases have already been rallied. The right and left bases have been rallied,” Manchin said. “It’s us in the middle that have to start making something happen here in Washington to move this country forward.”

    Machin, who also served as governor of West Virginia, said harsh rhetoric from either side does little to help the country.

    “Right, wrong or indifferent, whether you like the politicians, or not. There’s people who don’t like the extreme Democrat politics or extreme Republican politics, we got to start being Americans again,” the senator said.

    A spokesman for Koch Industries said Manchin’s comments likely reflect what others, on both side of the aisle, are thinking and that “it’s about time” somebody spoke out.

    “My guess is that Sen. Manchin has expressed a point of view that a lot other senators — Democrats, Republicans — have probably wanted to say and haven’t,” Steve Lombardo said.

    A request for comment from Reid’s office was not immediately returned.

        The U.S. Department of Justice and Environmental Protection Agency have fined a Texas chemical plant controlled by Koch Industries Inc. $350,000 for emissions violations and will require the company to spend more than $44 million on upgrades.

        The plant in Port Arthur, Texas, is part of a refining and chemical complex owned by Flint Hills Resources, a division of Koch Industries, which is controlled by politically active brothers Charles and David Koch. The Koch brothers are longtime financial backers of conservative causes.

        According to the Justice Department, Flint Hills violated EPA regulations designed to limit emissions from leaking equipment and operated the plant’s flaring equipment improperly, allowing excess amounts of benzene and other harmful substances to be released.

        Details of the settlement between the company and regulators announced on Thursday include $28 million earmarked for new leak detection equipment and a $16 million system to recover and recycle waste gases before they’re flared into the atmosphere.

        The company will also spend $2 million to retrofit diesel vehicles operated by the City of Port Arthur with equipment to improve emissions and another $350,000 to help improve energy efficiency in local low income homes.

        “This settlement will mean cleaner, healthier air for residents of the Port Arthur area who continue to bear a disproportionate burden from the impacts of industrial pollution,” said Robert G. Dreher, Acting Assistant Attorney General in the Justice Department’s Environment and Natural Resources Division.

        Phil Gaarder, vice president of operations for Flint Hills Resources, said the plant had already started upgrade work prior to the agreement.

        “We are pleased to have worked cooperatively with the EPA to reach an agreement that benefits area residents and appreciate EPA’s commitment to identifying community projects with local support that will provide for additional emissions reductions in the area,” Mr. Gaarder said.

        Flint Hills’ Port Arthur chemical plant manufactures ethylene and propylene, which are used to create plastics and other materials used in equipment such as medical devices and automotive parts.

        The Justice Dept. and EPA have taken a number of actions against industrial facilities, such as chemical plants and refineries, in recent years to reduce hazardous air emissions. In July 2013 Royal Dutch Shell PLC reached a deal with regulators to pay a $2.6 million fine and spend at least $115 million at its Deer Park, Texas refinery. In May 2012 BP PLC agreed to pay an $8 million fine and spend more than $400 million on new equipment at its refinery in Whiting, Ind.

            A Republic is representative government ruled by law (the Constitution). A democracy is direct government ruled by the majority (mob rule). A Republic recognizes the inalienable rights of individuals while democracies are only concerned with group wants or needs (the public good).

            Lawmaking is a slow, deliberate process in our Constitutional Republic requiring approval from the House, Senate, Executive (President or Governor), The Supreme Court, and individual jurors (jury-nullification). Lawmaking in our unlawful democracy occurs rapidly requiring approval from the whim of the majority as determined by polls and/or voter referendums. Voter referendums allow legislators to blame bad law on the people. A good example of democracy in action is a lynch mob.

            Democracies always self-destruct when the non-productive majority realizes that it can vote itself handouts from the productive minority by electing the candidate promising the most benefits from the public treasury. To maintain their power, these candidates must adopt an ever-increasing tax and spend policy to satisfy the ever-increasing desires of the majority. As taxes increase, incentive to produce decreases, causing many of the once productive to drop out and join the non-productive. When there are no longer enough producers to fund the legitimate functions of government and the socialist programs, the democracy will collapse, always to be followed by a Dictatorship.

            Even though nearly every politician, teacher, journalist and citizen believes that our Founders created a democracy, it is absolutely not true. The Founders knew full well the differences between a Republic and a Democracy. They repeatedly and emphatically said that they had founded a Republic.

            Article IV Section 4, of the Constitution “guarantees to every state in this union a Republican form of government”…. Conversely, the word Democracy is not mentioned even once in the Constitution. Madison warned us of the dangers of democracies with these words,

            “Democracies have ever been spectacles of turbulence and contention; have ever been found incompatible with personal security or the rights of property; and have in general been as short in their lives as they have been violent in their deaths…”,

            “We may define a republic to be … a government which derives all its powers directly or indirectly from the great body of the people, and is administered by persons holding their offices during pleasure for a limited period, or during good behavior. It is essential to such a government that it be derived from the great body of the society, not from an inconsiderable proportion or a favored class of it; otherwise a handful of tyrannical nobles, exercising their oppressions by a delegation of their powers, might aspire to the rank of republicans and claim for their government the honorable title of republic.” James Madison, Federalist No. 10, (1787)

            Our military training manuals used to contain the correct definitions of Democracy and Republic. The following comes from Training Manual No. 2000-25 published by the War Department, November 30, 1928.

            DEMOCRACY:

            A government of the masses.

            Authority derived through mass meeting or any other form of “direct” expression.

            Results in mobocracy.

            Attitude toward property is communistic–negating property rights.

            Attitude toward law is that the will of the majority shall regulate, whether is be based upon deliberation or governed by passion, prejudice, and impulse, without restraint or regard to consequences.

            Results in demogogism, license, agitation, discontent, anarchy.

            REPUBLIC:

            Authority is derived through the election by the people of public officials best fitted to represent them.

            Attitude toward law is the administration of justice in accord with fixed principles and established evidence, with a strict regard to consequences.

            A greater number of citizens and extent of territory may be brought within its compass.

            Avoids the dangerous extreme of either tyranny or mobocracy.

            Results in statesmanship, liberty, reason, justice, contentment, and progress.

            Is the “standard form” of government throughout the world.

            The manuals containing these definitions were ordered destroyed without explanation about the same time that President Franklin D. Roosevelt made private ownership of our lawful money (US Minted Gold Coins) illegal. Shortly after the people turned in their $20 gold coins, the price was increased from $20 per ounce to $35 per ounce. Almost overnight F.D.R., the most popular president this century (elected 4 times) looted almost half of this nation’s wealth, while convincing the people that it was for their own good. Many of F.D.R.’s policies were suggested by his right hand man, Harry Hopkins, who said,

            “Tax and Tax, Spend and Spend, Elect and Elect, because the people are too damn dumb to know the difference”.

            These are the things which people do not know about him.

            Of course, the Koch brothers are leading advocates of a free-market economy and all-important issues of liberty. As Charles Koch wrote yesterday in an op-ed in the Wall Street Journal, he is “Fighting to Restore a Free Society,” and “Instead of welcoming free debate, collectivists engage in character assassination.” He could not be more right. Senate Majority Leader Harry Reid (D-NV) recently said that the billionaire Koch brothers are “un-American.” For daring to speak out against Obamacare, Reid said, “It’s too bad that they’re trying to buy America, and it’s time that the American people spoke out against this terrible dishonesty of these two brothers who are about as un-American as anyone I can imagine.”

            How terrible is it that a private citizen is attacked by the Senate Majority leader, Harry Reid. Imagine a private person is forced to write an op-ed in one of the nation’s most influential papers, where he writes, “[T]he fundamental concepts of dignity, respect, equality before the law and personal freedom are under attack by the nation’s own government.” Of course, we saw it coming, when Obama in a well-publicized speech to business owners during his re-election campaign said, “You didn’t build that.”

            Koch is so right when he writes that “[t]he central belief and fatal conceit of the current administration is that you are incapable of running your own life, but those in power are capable of running it for you. This is the essence of big government and collectivism.” (This government also wants to run the lives of people in countless other foreign nations as well.)

            Read this paragraph in Koch’s op-ed:

            Koch companies employ 60,000 Americans, who make many thousands of products that Americans want and need. According to government figures, our employees and the 143,000 additional American jobs they support generate nearly $11.7 billion in compensation and benefits. About one-third of our U.S.-based employees are union members.

            Is not an employer of that size and magnitude worthy of private dialogue? Or a certain level of respect?

            The Koch family employs 60,000 Americans, donates hundreds of millions of dollars to philanthropic (non-political) causes, and they are attacked as un-American? These private citizens who are among the most prominent executives and philanthropists are attacked by the most powerful man in the world and his allies for opposing the Democratic Party and exercising their democratic rights.

            This is what Obama’s America has come to. It’s awful, unfair and brutal. The right admires and respects hard-working executives, while the left hurts and attack. All the American people should say to this fine family is: “Thank you.
