Legitimize What Can’t Be Proven: Comey’s ‘October Surprise’

Sorry, but I’ve seen this movie before and I know how it ends. There will never be a criminal prosecution of Hillary Clinton for two basic reasons: First, she’s a cautious, intelligent politician who doesn’t take reckless chances. How many failed “investigations” before Republicans get that?

Second, bogus charges against prominent individuals with first-rate attorneys endanger the prosecution more than the defense. You think the formerly eminent Kenneth Starr fled to Waco, Texas because he was insufficiently partisan? His ace prosecutors lost every “Whitewater” trial except the one where they convicted his own star witness, poor, sick Jim McDougal.

But let’s go back to the starting place, October 1992, because what happened then has a direct bearing on today’s headlines.

Based upon some inept, not particularly honest articles in the New York Times, an unqualified partisan in the Treasury Department—she later admitted selling “Presidential Bitch” coffee mugs from her government office—cobbled together criminal referrals naming just about every prominent Democrat in Arkansas as a suspect in Jim McDougal’s financial shenanigans.

They included Bill and Hillary Clinton, who the evidence would show—and Kenneth Starr’s prosecutors eventually argued in open court—had been swindled and lied to in McDougal’s vain attempt to keep his foundering savings and loan, Madison Guaranty, from going under.

As the 1992 presidential election grew closer, the partisan L. Jean Lewis began to pressure the Little Rock FBI office and U.S. Attorney Charles “Chuck” Banks to investigate the Clintons. Banks was a lifelong Republican who’d been nominated to a federal judgeship by President Bush. Unless the president was re-elected, Banks would lose two good jobs.

Having previously prosecuted Jim McDougal, Banks and his staff found Lewis’s work both factually deficient and politically-motivated. Soon, pressure began to come from FBI headquarters in Washington. Bush administration Attorney General William Barr demanded action.

So the Republican prosecutor wrote a letter to the Department of Justice dated October 16, 1992. Here is what it said:

“[T]he insistence of urgency in this case appears to suggest an intentional or unintentional attempt to intervene into the political process of the upcoming presidential election. You and I know in investigations of this type, the first steps such as issuance of grand jury subpoenas for records will lead to media and public inquiries about matters that are subject to absolute privacy. Even media questions…all too often publicly purport to ‘legitimize what can’t be proven.”

For me personally to participate in [such an] investigation…amounts to prosecutorial misconduct and violates the most basic fundamental rule of Department of Justice policy. I cannot be a party to such actions.”

He promised to direct any press inquiries to the Attorney General, which would have been politically devastating in that innocent era before the United States’ current flirtation with fascism.

Banks understood that whoever won the 1992 election, his political career was over. He preferred to keep his honor.

History records that he was also right on the merits.

“Legitimize what can’t be proven.” Remember that phrase as you watch cable TV hucksters hyperventilate about FBI Director James Comey’s ill-advised and arguably illegal “October surprise.”

Meanwhile, don’t tell me what a terrific lawyer and standup guy Comey used to be. That guy no longer exists. What we have instead is a spineless partisan who planted an IED in the middle of the 2016 presidential election—apparently because he feared criticism from GOP congressmen who drink from “Presidential Bitch” coffee mugs.

And who tried to explain away his original weasel-worded letter to Congress with an even more craven apology to his FBI colleagues.

“Given that we don’t know the significance of this newly discovered collection of emails,” Comey whined, “I don’t want to create a misleading impression.”

Oh no, anything but that!

He also admitted “There is significant risk of being misunderstood.”

Well I’m sorry, but there’s just no chance that a Washington insider as experienced and ambitious as Comey could possibly not anticipate the feverish speculation his letter was certain to set off.

My goodness, does the man not own a TV set? Has he never seen Wolf Blitzer in action? Breaking News! Bombshell!!

Was Comey been unaware of Donald J. Trump barnstorming around the country promising to put “Crooked Hillary” in prison while his supporters chant “Lock her up?”

Psychologists call it projection: the only way to rationalize supporting a moral cripple like Trump is to convince yourself his opponent’s worse.

Such antics risk a descent into the kind of society where the only real police are the Secret Police, and the judiciary exists to rationalize brutality. A society like Vladimir Putin’s Russia, for example, where the bureaucracy is filled with useful drones who have bartered their honor for comfortable positions.

Comey could undo some of the terrible harm he’s done to American democracy if he’d simply admit error and resign.

Alas, I just don’t think it’s in him.

    The latest line of attack, which involve not only Comey’s infamous memo, but now releasing files related to Bill Clinton pardoning a donor to his library in 2001, has two objectives. The first is to influence the outcome of the election, the second is to make sure Hillary cannot govern, if elected.
    What is happening now, which also include Republican controlled state governments closing polls in districts with large African American population in North Carolina, bring back memories of hanging chads, delayed and cancelled recounts, Willie Horton, and all the other shenanigans that make a mockery of our claim of being a bastion of freedom and democracy.
    The GOP, including a right leaning FBI, have turned our election process into a farce worthy of every totalitarian, banana Republic, in the world. All of this while cynically claiming that our electoral system is rigged, and criticizing the elections held in other countries. Shameful.

      Right you are Dom. I am with you on 100% on this. But I can’t help but believe there is a limit. There is always a limit to everything, is there not? A line out there somewhere I have to believe exists that a large majority of us will refuse to cross. A cost of “winning,” that the People cannot in all good conscience pay. In spite of the partisanship, and as a matter of just plain common sense, and decency, be convinced to go a step further.
      I truly believe Dom, there is a point where the people I see in this Country. Most who are not the wild eyed radicals we see on Fox on a daily basis, or hear on call ins to Limbaugh, or Alex Jones. But a vast consortium who will in mass refuse to continue to allow themselves to be shoved, frightened, cajoled, and manipulated down an extremist path of anti-democratic, and even pre-revolutionary chaos that would imperil everything dear to them. To in fact, burn down our democracy in some despicable reckless act, because a loud faithless cynical minority demand we help them do so. A small mob of disbelievers, and malcontents who have shown they will go to any lengths to see their traitorous agendas carried out, no matter who is trampled, or what is left of our Country, and liberties when they are finished with it.
      No, I believe our Country still exists pretty much where it’s always been. Inhabited by patriotic citizens who live near, and on one side or another of the center where Left meets Rights. Who may cuss their gov. but continue to believe in their Gov. and in its institutions, warts and all. So there has to be limit to what we’re seeing. And I have to believe, it must be close.

        Incredibly, millions of fellow Americans support Donald Trump, in spite of all his character flaws, criminal activities, and pathological lying. He is now leading in Florida, North Carolina, Ohio, Iowa, and Nevada. If Wisconsin and New Hampshire follow suit, Hillary’s chances are going to be in serious trouble.

          Then I will be proven wrong, at least for the time being. And we’ll see how hard the mule needs hit between the eyes to gain his attention.
          Because I could simply not see the Country making a bigger mistake than electing Trump. Like we decided once upon a time, Bush or Gore? What would be the harm many thought in giving the other fellow Bush a chance to change things around a little bit?
          I see the Republican support of Trump as being more about the Supreme Court than about supporting an nearly unpalatable Trump. And the partisan gamble, that Trump as President can be managed via Congress. And what is seen as an imperative Conservative Court may thus be preserved, or lost forever.

I just pull in a different direction from the Right. I am sincerely hoping that Hillary along with a Democratic Senate puts this as the first order of business and fills ALL the vacancies forthwith. And tend to any future vacancy immediately considering the opening the Republicans have for retaking the Senate in 2018.

          Actually, Trump only has 35% of the vote and it is all in the states that cost the rest of the states the most in federal tax handouts. So you can see why these states support Trump. They want to be the sole recipients of our tax dollars.

          I have much doubts whetherTrump will carry Florida. Forget about polls for a while. When you see 28% of republicans who have voted already supported Hillary, that tells something. Florida has a good number of educated. They have assessed these two candidates and know which candidate suits the job. They don’t care about parties. Morever, hispanic voters are voting in droves.

            That’s an interesting opinion, well within the real of possibilities. Especially when we consider that Trump is the least conservative candidate to ever get the GOP nomination. Either that, or the neo-conservatives are very different ideological values than their elders. Consider Trump’s attacks against the global economy, international trade agreements and other proposals that are the exact opposite to what the GOP has embraced for decades. Pence is a lot closer to a true conservative than Trump will ever be.

        People refused to buy into the attempts to destroy Bill Clinton. Polls showed strong opposition to his impeachement and he left office with high approval ratings. I just keep hoping the public has not lost that ability to see through the propaganda and will use their common sense.

          Common sense versus the onslaught of radical propaganda put on technological steroids. At some level we must know where we stand, or like they say, we risk falling for anything. It is my belief in this election, maybe more than ever before, where we must decide we either believe in our democratic processes, in the superiority of them. Or we’re talked into abandoning them for the wilderness of the unknown. My sense is that we not nearly as ready to head down that path than the heated rhetoric of an untested demagogic conman would suggest.

When I dare to make any legitimate criticism of HRC Eleanore flips out because seeing Hillary as anything less than perfect is an unforgivable sin and automatically makes you a right winger in her mind. At least I’m not willing to contribute to a potential international disaster and know this, these leaders are just as self-important and egotistical as Trump with short fuses if insulted .Remember the long horn sign Bush gave in the country that viewed such symbol as an insult to their nation? It made major headlines and had it not have been for diplomacy it could have lost us an ally, now imagine Trump doing the same or something similar but refusing to apologize or allowing his advisers to use diplomatic concessions because he didn’t view it as an insult therefore he will not retract… Yeah, that’s what I’m talking about.

        Our problem is not only the shenanigans being used by the FBI to influence the outcome of the election, but the fact that large numbers of Democrats have not voted, or remain either in denial or too complacent. The key to win, at this late point in the campaign, is to mobilize the base. Hopefully President Obama can do just that in NC today, where African Americans are being disenfranchised, or are simply not too impressed with either candidate and staying home.

      Given the odd timing of the revelation of both the Weiner emails and the Clinton pardon by Comey, along with the potential interference in the election, it would be reasonable for the Attorney General to appoint a special prosecutor to determine if Comey or the FBI had had any dealings (e.g., emails) with members of the Trump campaign or the RNC. Of course, we can be certain that if there were any evidence linking Comey to the Republican campaign that such evidence would probably have been destroyed by now. (Of course, Nixon had those pesky tapes . . . ) Funny thing, though. Emails have this nasty habit of residing somewhere other than where the writers or receivers of the emails think they reside. I’d suggest that at 9:00 AM on November 9, 2016, Lynch appoint a special prosecutor to look into this mess. It is highly unlikely that this is simply a coincidence.

          Gowdy wanted to try and make the case that “negligence” is a federal crime deserving of prison time. Hillary admitted using a private email server was “negligent” given that it was easy to be hacked.

          So if Gowdy can demand every detail of every email in Hillary’s past, how the hell come Gowdy can’t demand Trump disclose his taxes?

          The GOP’s refusal to disclose Trump’s taxes will be the real reason Trump loses this election. That and the fact that Trump’s mind is gone. However, it will also be the same fact of refusal to disclose his taxes, that will force Trump to sue the Republicans when he loses.

        Comey knew he would lose in court because there was no evidence of a crime and that would ruin reputation. Comey was part of the Whitewater investigation so you can bet he would have brought charges if he thought there was even a small chance of winning. As this article points out even Ken Starr had to give up his quest for lack of evidence after wasting $70 million of our tax dollars.
        As Elijah Cummings pointed out Comey repeatedly told the committee that his priority was protecting his reputation. (Not doing the right thing.)

        It’s is a case of an indictment being subjected to real evidentiary procedure in a real court of law. As averse to propagandized mob talk and spurious politically motivated innuendo. It’s also about a prosecutor being willing to put putting his credibility on the line in bringing forth such a baseless charge, or keeping it by refusing to take such a case forward.

I get difficulties to understand after the major failure of producing wrong information on WMD in Iraq and thousands died because of the incompetence showed, I don’t see the issue of Hillary’s emails even deserves to carry any weight. It is all about going after each other due to Party affiliation.

        According to the Wall Street Journal – hardly a liberal rag – there is a group of essentially rogue FBI agents who want to take down the Clintons. They have been pushing their bosses in the Justice Department to allow them to investigate the Clinton Foundation despite even after Justice has ruled there is not evidence to justify it. Still they are doing some investigating anyway. It looks like Comey has completely lost control of the agency.

    You know what really fries right wing and Republican brains? They think because they have a Senate and House Majority now, they can override executive orders from the executive branch of government. That way, they can do whatever they please to anyone they please and get away with it.

    When you consider this mentality, you see the Republicans are nothing more than a tyrannical regime. We all knew Trump is dirtier than dirty. We all knew Trump would sink lower than low. What we never expected was for him to embarrass the entire country and take the government down with him.

    Right now, the Republicans think they’ve gotten their way. Come Nov. 8, they will either dismantle the election results by dismissing it and claiming all of our votes were rigged or they will out and out do a regime takeover. Why else allow Trump who is in cahoots with the Russians to run for their Party?

    Hillary Clinton, as America’s longest running free roaming felon, is no longer running against Trump. She is running against the FBI, and the FBI isn’t interested in polls, vote counts, or the electoral map, they are interested only in EVIDENCE. And they are currently poring over 650,000 pieces of juicy evidence that history will eventually document as the downfall of the Clinton Crime Enterprise. Bill and Hillary Clinton are done, finished…..it’s only a matter of time. The only question will be from what location Hillary will be led on her perp walk when she is arrested. If she loses next week, it will be from her mansion at Chappaqua. If she wins next week, it will be from the White House. And the long national nightmare of the Clintons will be over!

        You must not be very smart. Eamils are chain linked between computers. Therefore, crooked Hillary’s emails are potentially on any given computer in the world, whether because she sent email to the person holding that computer or she was hacked and bulk data moved from her computer to another. It’s her email, no matter where it is found. Is that too difficult for you to grasp?

      We can always hope that this will spur someone, somewhere, to request the FBI be investigated inside and out! They have totally lost the respect of the American public, and it needs to be reinstated by a thorough investigation into the doings of the FBI; and if there are agents in New York who aren’t doing their jobs or are doing something they’ve been told NOT to do….that needs to be rectified immediately and they need to be taken out of the field and put somewhere where they can’t cause problems…..perhaps in Antarctica or somewhere just as interesting!

    Good article, but I disagree about Comey’s having to resign. He should be fired and he should lose (the magic word of) his pension. Comey’s own words and injecting his opinion into a legal case would cause the case to be thrown out of Court. Why did he wait this long for the E-mails, but agreed that the investigation into Trump’s connection with Russia and Putin should wait? Why did Comey ignore the protests of others in his own agency that he would be interfering with the presidential election?

          Again, I would LOVE to see the original warrant for Weiner’s e-mails because if it clearly said “WEINER’s E-Mails,” then they have NO right to look at any others, including anything between Huma and Hillary. Most warrants are pretty specific as to what they can or can’t look at. I can’t think of any reason why they would just make a “general” warrant for ANY e-mails on this particular laptop.

            What I remember about the WeinerGate investigation from the NY Daily News and the NY Post accounts was that Weiner first used his cell phone which the then FBI confiscated. In those days, sexting was considered lewd and lascivious behavior. Then, about two weeks later, Weiner was caught again. This time using his wife’s laptop.

            Huma tried to stand by him when his cell phone was confiscated but we all knew his political career was over. By the time Huma found out he used her laptop, she had no choice but to file for divorce.

            You can check out the archives of these papers back about 10 years ago.

            The FBI had a warrant back then. But, all warrants are not evergreen. They expire. That’s why Comey very likely stepped into a big mess if he assumed that the FBI Dir. who originally got the warrant gave him privilege to use an expired warrant. He is either too stupid to live or Trump paid Comey big money.

No, because not having the authority to read them in the first place would prevent them from coming out BUT if someone ‘accidentally’ nosed around and found something beyond superficial then following protocol with unbiased investigation they could request a judge to re-open the laptop and include all emails but then after reading what has no bearing to their accusations, unless it was a drunken partisan judge I doubt they would get their wish. Bottom line, it has to do with due process and not loose lips on a case that should not be discussed until proof is found or do you think that part of the constitution doesn’t apply to certain people that you hate?”

      Good questions…all of them. These are questions Hillary will have to get answers to once she’s elected! I just hope that she does the right thing, but I think that, no matter what she does, she’ll get the blame for whatever is the outcome. She’d probably be wise to wait until her first year in office is up before going after Comey and his gang…..otherwise, the GOP will accuse her of revenge tactics! I do agree, however, that the FBI needs to be seriously investigated for many reasons!

    When I watched the CNN airing of the last EmailGate investigation, it was kind of hilarious to watch Gowdy and Chaffetz both struggling to turn the word, “negligence” as stated by Comey into “federal crime.”

    But, isn’t that exactly what the Republicans did to Pres. Clinton? They had the gall to turn “sexual misconduct” into an article for impeachment when all along they hid that their own Hastert was playing with little boys for 17 years. Make sense to you? Me either.

    Then, they called a consentual act between Monica Lewinsky and Bill Clinton “sexual misconduct” and look the other way when Gingrich handed his wife divorce papers while she was undergoing chemo in the hospital. But no…no sexual misconduct there. Just a Good Ole Good Ole boy deflecting his own guilt onto Clinton. How do these Republican men sleep at night?

    I’m not sure I agree with the underlying proposition of this article that Mr. Comey is no longer “a terrific lawyer and a stand up guy”. According to his resume … he was a US District Attorney for 2 yrs and US Deputy Attorney General for <2 yrs (taking down Martha Stewart and other high profile defendants). He left DOJ to become General Counsel for Lockheed Martin and after 5 yrs he became General Counsel for a hedge fund for 2 yrs- while also serving on the Board of Directors of the Hongkong Shanghai Banking Corp’s holding company, after they made a $1.9 billion settlement with DOJ for compliance failings vis-à-vis charges of Mexican Cartel money laundering and terrorism financing. After that, he was a law school fellow for a yr before getting the job as director at the FBI. Frankly, this is not the resume of a ‘terrific lawyer and a stand up guy’. It looks more like that of an ambitious attorney who’s preparing himself for higher public office. And let’s face it he’ll need the support of his political party, which explains a lot about how he’s handled the investigation of HRC. He knew he didn’t have a case against her, but he gave an unusual press conference to damage her reputation anyway (very consistent with what Rep McCarthy said was the original intent of the Congressional hearings on Benghazi). Then, to further appease his party, Mr. Comey takes the unprecedented act of turning over FBI investigation notes to his party’s other Congressional committee on HRC's emails. Then, he affirmatively protects his party’s candidate for the Presidency by refusing to release adverse information about him. Hum, Mr. Comey is a "stand up guy"? Really? Unfortunately, there’s not much anyone can do to stop him … other than remember these episodes when he declares his intent to run for a higher office – or when his political party tries to reward him with a lifetime appointment to the judiciary.

      Then you also know that Comey was one of Ken Starr’s chief White Water prosecutors. Comey has what all women recognize as insatiable male ego that is driven to acts that are not always “honorable.”

      It is barely possible that having served with Ken Starr on White Water for 12 years and having no proof of guilt, Comey kept his hatred for Hillary under his skin for decades.

        Actually Comey was assistant Special Prosecutor for the Senate Whitewater Committee. When Vince Foster died he had some Whitewater documents in his office which Hillary had removed and locked up. The net result was Comey came away thinking that she did not act naively and went way beyond “aggressive lawyering.” He thought her actions bordered on obstruction of justice. We all heard him deliver his “judgment” in July. He had held it in for 25 years. And now he has come back for a 2nd bite since she was still winning in late October. He needed to look around him at where all his Whitewater cohorts are now. Only one still standing is Lindsey Graham.

      What I’m upset about is the fact that Comey and his gang have done NOTHING to investigate the many Trump problems; i.e., his Russian connections, his “Trump Foundation” fiasco, and every other thing that has come up that should have been investigated. Why did they spend so much time on investigating Clinton but so little time investigating Trump. Now, all of a sudden, they say they are investigating his connections with the Russians…..NOW? Why wasn’t this done much earlier in the campaign? Very questionable!

    Comey the terrific lawyer and standup guy never existed in my opinion. He was a fave of the Villagers in the mainstream media who are easily bamboozled by appearances. After all they thought that Ken Starr was a principled guy who would never use the law for partisan purposes. They also lionized Louie Freeh as a Boy Scout who would always do the right thing. Freeh worked hand in glove with Starr to take down Clinton.
    Comey was also involved in the Whitewater scam which should have made him suspect from the beginning. Elijah Cummings recently said that Comey repeat day told his committee that his first priority was protecting his own reputation. Not following the law, not protecting the reputation of the FBI, but protecting himself. That is what he is about.
    I hope the outcome of this is that Democrats finally learn not to get bamboozled by the Villagers into appointing a Republican to positions of power the way Clinton di with Freeh and Obama did with Comey. Fool me once……

      Actually, I believe Bush was the one that appointed Comey; President Obama just left him in the position as it was a 10-year position and he had nothing that would be considered bad at the time to warrant firing him. It’s unfortunate, but that’s the way the system works.

            I cannot disagree at all. IF the democrats take the Senate, then Obama will have a chance to fix the problem. Ask Comey to resign or fire him, effective at the end of the year or on January 20. The serious slide in HRC’s poll numbers certainly says Comey’s announcement has impacted the election. That gives Hillary an opportunity to appoint and HAVE CONFIRMED an FBI Director. There is no way Comey can continue in that office but to fire him right after the election sets up the Republican scream machine immediately while they are still in the majority in the Senate.

        Actually Comey was Deputy Attorney General under Bush then left the government. Obama appointed him to be FBI Director in 2013. He took over from Mueller.

    Decency and fair play are not in the Republican lexicon. They are releasing new attack ads which are so misleading that they can only be characterized as lies. At least one of them features an unseen narrator interspersed with clips of Hillary making statements that were made in a totally different context than the narrator leads the viewer to believe. It will be great fodder for low information voters but reduces political campaigns to a war of battling against lies. Of course that is what Comey was counting on too.

    I’d be interested in seeing the original warrant for the e-mails. If they were interested in ONLY the e-mails from or to Weiner, they had NO right to go after any e-mails NOT sent or received by Weiner on this particular laptop. So, if the warrant said ALL e-mails on this particular laptop or if it said only e-mails pertaining to Weiner….then this could be questionable. Thus, I’d like to see a copy of the original warrant. It should have been specific to his e-mails only and not for anything Huma sent or received that had nothing to do with Weiner’s problem.

        Actually, when WeinerGate broke nearly 10 years ago, the joke about him was that we all knew that there were NY boro Republicans who were desperate to get another NY City mayor. But the rumor then as now was that Guiliani was using his former “pull” to take down Weiner. Not that he wasn’t guilty mind you. But the woman involved was from Seattle WA and was 21 years old. Not a minor like the 13 year old Trump raped.

    When it comes to elections, you can never trust a Republican. They will lie, cheat, steal, disenfranchise voters, and do anything it takes to win an election that is going bad for them. Obama should have never named a Republican for any important position in his administration. Obama’s problem is this. He a decent, moral, intelligent, classy gentleman dealing with a bunch of slobbering, rabid, degenerate mongrels called the GOP. He gave Comey too much credit. He is a Republican after all. Comey has now gone even lower than the RNC and Trump and turned this election into a complete disgrace. Meanwhile Putin is rubbing his hands in anticipation of the possible Presidency of the Squirrel Haired Taint Dragon which will hand Putin the power to do as he wishes in world. Good job Comey. You’ve disgraced yourself for ever and destroyed the integrity of the FBI!

      Comey was never a Hero in anyone’s eyes because he held a press conference to fluff himself, and try to explain to his Republican friends why he wasn’t prosecuting Clinton… by saying he had nothing. Literally nothing. But giving freely of case details while telling everyone how bad and careless she’d been.
      No-one else gets treated this way.

      The correct path of action was to issue the standard terse: “Investigation complete. Recommend no prosecution.” to the DOJ for them to decide what to do.
      Did he do that? Hell no. He went on TV!

      While the verdict was welcome (and inevitable), the way he did it, plus the following Stunt Congressional Hearing where he again got to grandstand about how terribly she had handled her emails, never got him applause from the Dem camp. The opposite if anything.

      He politicized the FBI. To protect himself.
      He has simply done the same thing again… this time with a letter.
