Judge Mehta Handed Trump A Major Defeat On January 6 Lawsuits

Former "defeated" President Trump's bigly bad week concluded with US District Judge Amit Mehta flatly rejecting his motion to dismiss three cases regarding his conduct on January 6, 2021, thus allowing the major suits to proceed. And assuming the ruling holds amid a Supreme Court stuffed with Trump goons, it's almost inevitable that Mr. Fifth Amendment will be forced to go under oath during discovery.

The three cases consist of Swalwell v. Trump, in which Democratic Rep. Eric Swalwell sued Trump, Rudy Giuliani, Don Jr. and GOP Rep. Mo Brooks; Thompson v. Trump, in which 11 Democratic representatives sued the former president, his lawyer, and both the Proud Boys and the Oath Keepers; and Blassingame v. Trump, in which two Capitol Police officers are looking to hold Trump accountable for their injuries on January 6. Most important, all the plaintiffs sued under the premise that Trump and the other defendants conspired to violate the Ku Klux Klan Act of 1871, a Reconstruction Era statute that makes it illegal to impede a government official carrying out his or her official duty. Moreover, impeding the transfer of power to Joe Biden.

Trump has vigorously (and poorly) argued that he was simply exercising his First Amendment right in summoning the mob to DC, in which he instigated their violent reaction with election lie after lie. In order to chip away at this defense, the plaintiffs have alleged trump engaged in illegal incitement. In other words, his speech was “directed to inciting or producing imminent lawless action,” and that it was “likely to incite or produce such action," which is known as the Brandenberg standard.

According to Judge Mehta, the plaintiffs appear to have satisfied that need.

"The prospect of violence had become so likely that a former aide to the President predicted in a widely publicized statement that “there will be violence on January 6th because the President himself encourages it.” Thus, when the President stepped to the podium on January 6th, it is reasonable to infer that he would have known that some in the audience were prepared for violence," wrote Mehta.

"Yet, the President delivered a speech he understood would only aggravate an already volatile situation. For 75 uninterrupted minutes, he told rally-goers that the election was “rigged” and “stolen,” at one point asserting that “Third World Countries” had more honest elections. He identified who the culprits were of the election fraud: “radical Left Democrats” and “weak” Republicans. They were the ones who had stolen their election victory, he told them. He directed them not to “concede,” and urged them to show “strength” and be “strong.” They would not be able to “take back [their] country with weakness.” He told them that the rules did not apply: “When you catch somebody in a fraud, you’re allowed to go by very different rules.” And they would have an “illegitimate President” if the Vice President did not act, and “we can’t let that happen.” These words stoked an already inflamed crowd, which had heard for months that the election was stolen and that “weak politicians” had failed to help the President."

With the legal ramifications and ruling that Trump and his spawn must respond to questions about the Trump Organization, the possibility of Trump being tried for stealing classified documents, and now a DC judge's ruling rejecting Trump's desire to dismiss lawsuits pertaining to the violent DC insurrection, the walls appear to be closing in on the twice-impeached, one term, con man.

WhenDonald Trump all but promised to pardon everyone involved in the January 6 attack on the U.S. Capitol at a Texas rally Saturday night if he gets re-elected he wasn’t pulling the idea out of thin air. In fact, as President, Donald Trump repeatedly investigated the idea, including discussing issuing a pre-emptive blanket pardon for what are now nearly 800 people who so far have been charged, so they “would never have to testify or be deposed.”

“Do you think I should pardon them? Do you think it’s a good idea? Do you think I have the power to do it?” Trump reportedly asked one adviser several times during his final weeks in the White House, Politico reports.

Another adviser also discussed the blanket pardon idea with Trump:

“Is it everybody that had a Trump sign or everybody who walked into the Capitol” who could be pardoned? Trump asked, according to that adviser. “He said, ‘Some people think I should pardon them.’ He thought if he could do it, these people would never have to testify or be deposed.”

On Saturday in Texas Trump told supporters, “If I run and I win, we will treat those people from January 6 fairly.”

And if it requires pardons, we will give them pardons, because they are being treated so unfairly,” he claimed, falsely.

Trump doubled down this week on Newsmax, saying if re-elected he would “absolutely” pardon them.

Marjorie Greene Cares More About Jail Conditions For Capitol Rioters Than Juvenile Offenders

Over the weekend, former President Donald Trump said that if he were somehow able to become president in 2024 (prison is more like it), he would hand out pardons to all the January 6 Capitol rioters. He took that boast up a notch -- clearly learning nothing from the first insurrection -- by encouraging his violent cult to mount similar "protests" should he actually be held accountable for his coup attempt.

Senator Lindsey Graham (R-SC), who vacillates between being an ordinary horrible person to being a flat-out Trump footstool, decided to play the former when he called Trump's remarks very inappropriate. Further, Graham said, “No, I don't want to send any signal that it was OK to defile the Capitol."

Little does Graham know that classiness and respect for the rule of law are big no-nos in today's fascistic GOP clown show.

Enter Marjorie Taylor Greene

In response to Graham's completely normal comments that one would expect from a Congressman in years past, Rep. Marjorie Taylor Greene went on Telegram (her far-right-insanity got her booted from Twitter) and accused Graham of not caring enough about pretending the election was stolen or doing anything to thwart the will of the people in the most legit election in our lifetime.

He didn’t care about election fraud in the 2020 election, even though thousands of Americans signed affidavits risking jail if they perjure themselves in court saying they witnessed election fraud.

He refused to object on J6 to Joe Biden’s electoral college votes.

He doesn’t care about our justice system being completely violated by Democrats in their political war against Republicans and President Trump.

Worse yet, the conspiracy-humping nut-bag went on a rant about how terribly the January 6 rioters are being treated and how Graham doesn't care. Incredibly enough, Greene seems to care more for a bunch of violent MAGA cultists than juvenile offenders in prison for far less serious crimes.

Pretrial J6 defendants are Americans who are being held in solitary confinement for up to 23 hours a day while rotting away in prison and they haven’t even seen a day in court.

For example, Green's name is nowhere to be found on a bill introduced by Texas Democratic Sen. Sheila Jackson Lee that limits the use of solitary confinement on juvenile offenders. But that shouldn't stop her from using the darkest hour in our democratic republic to score more brownie points with the MAGA crowd.

Of course, leave it to Greene to do anything and everything to perpetuate the insanity of Donald Trump.

Oath Keepers Chief: We’ll ’Scare The Shit’ Out Of Congress And Block Biden On January 6

The U.S. Department of Justice (DOJ) is working to detain Oath Keepers founder Stewart Rhodes following the release of text messages he allegedly sent that detailed his intentions for January 6.

As Rhodes prepares for trial in connection with the sedition conspiracy case alleging that he and members of the far-right extremist organization conspired to halt the certification of President Joe Biden's victory. On Thursday, January 20, lawyers for the federal government released a memo in district court with details about the evidence in the case and Rhodes alleged involvement.“The weight of the evidence of Rhodes’s dangerousness is immense,” the lawyers said in their memo. Text messages Rhodes sent are at the center of the investigation.

According to Rolling Stone, Rhodes “'spearheaded' the conspiracy to block the peaceful transfer of power." The government also wrote that Rhodes needs to be detained to 'protect the community, ensure his return to court, and safeguard the integrity of evidence and the proceedings.'”

"The filing offers choice new details, including a text Rhodes allegedly sent a co-conspirator on Christmas Day 2020, discussing their plan to intimidate Congress on Trump’s behalf during the proceedings on Jan. 6: 'The only chance we/he has is if we scare the shit out of them,” Rhodes wrote, “and convince them it will be torches and pitchforks time if they don’t do the right thing.'”

Lawyers also highlighted messages that detailed Rhodes' promotion of violence. “From November 2020 through January 2021,” it states, “Rhodes regularly used the terms ‘civil war’ and ‘revolution’ to describe the necessary path forward.”

The latest report follows the Justice Department's press release on January 13 detailing the charges being brought against the Oath Keepers. According to court documents, Rhodes, a resident of Grandbury, Texas, and Edward Vallejo, of Phoenix, Ariz., are facing charges in connection with the events leading up to the Capitol insurrection.

In addition to Rhodes and Vallejo, the nine other members of the far-right group include: "Thomas Caldwell, 67, of Berryville, Virginia; Joseph Hackett, 51, of Sarasota, Florida; Kenneth Harrelson, 41, of Titusville, Florida; Joshua James, 34, of Arab, Alabama; Kelly Meggs, 52, of Dunnellon, Florida; Roberto Minuta, 37, of Prosper, Texas ; David Moerschel, 44, of Punta Gorda, Florida; Brian Ulrich, 44, of Guyton, Georgia, and Jessica Watkins, 39, of Woodstock, Ohio. In addition to the earlier charges filed against them, they now face additional counts for seditious conspiracy and other offenses."
